By accessing or using the IsItWater API service ("Service") provided by Noreaster Group ("we", "us", or "our"), you agree to be bound by these Terms & Conditions. If you do not agree to these terms, please do not use our Service.

2. Description of Service

IsItWater provides an API service that determines whether a given geographic coordinate (latitude and longitude) is located on water or land. The Service uses data derived from OpenStreetMap and delivered via Protomaps.

3. Account Registration

To use the Service, you must:

• Create an account with accurate and complete information
• Be at least 18 years old or have legal capacity to enter into contracts
• Maintain the security of your account credentials and API keys
• Notify us immediately of any unauthorized access to your account

You are responsible for all activities that occur under your account.

4. API Usage

Permitted Use

You may use the API for lawful purposes in accordance with these Terms. This includes integrating the API into your applications, websites, or services.

Prohibited Use

You may not:

• Use the Service for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to our systems or networks

5. Credits and Payment

Credit System

The Service operates on a credit-based system. Each API call consumes credits from your account balance. New accounts receive complimentary credits upon registration.

Purchasing Credits

Additional credits can be purchased through our website. All payments are processed securely by Stripe. Prices are listed in US dollars unless otherwise specified.

Refunds

6. Data Accuracy

While we strive to provide accurate results, the Service is provided "as is" and we do not guarantee 100% accuracy. The data is derived from OpenStreetMap and delivered via Protomaps, and may contain errors or omissions. You should not rely solely on our Service for critical decisions without independent verification.

7. Service Availability

We aim to provide reliable service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any downtime or service interruptions.

8. Intellectual Property

The Service, including its design, features, and documentation, is owned by us and protected by intellectual property laws. You retain ownership of any applications or content you create using our API.

The underlying geographic data is provided by OpenStreetMap contributors under the Open Database License (ODbL).

9. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Indemnification

You agree to indemnify and hold harmless IsItWater and Noreaster Group, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your account and access to the Service at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason. Upon termination, your right to use the Service will immediately cease.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes by posting the updated Terms on our website. Your continued use of the Service after changes constitutes acceptance of the new Terms.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
